Acceptable Use Policy (AUP)

1. LEGAL TERMS. creativeVPS intends to provide a secure, and efficient environment to host your VPS. The customer is prohibited from using the services provided by creativeVPS in a manner that would intentionally or unintentionally violate the law of the United States or International law. The customer is prohibited from using the service(s) provided by creativeVPS in a matter that (is): threatening, malicious, defamatory, abusive, unethical, violates privacy, promotes hacking, violates copyright or patent protection, causes the spread of computer viruses or other damaging programs or data files. creativeVPS reserves the right to suspend service at first notification of illegal use of our services. Customer will still continue to receive invoices, and be expected to pay their next term on the service if not 7 days prior to renewal date.

2. SPAM MAILING. The customer is prohibited for entailing in activity that results in the receipt of unwanted junk, bulk, or unsolicited spam email in a users inbox. In any case of bulk mailing, the customer must provide a clear " Unsubscribe" link, and comply with any notices from spam orginazations such as SpamHaus etc. Should the customer continue illegally spamming users, your service will be subject to immediate suspension, pending $85 reinstatement fee, and the resolution of spam conditions.

3. NETWORK TRANSMISSIONS. The customer will be held responsible for all incoming and outgoing data that is coming from the origin of service. This includes all files, legal and illegal. In no way, shall a customer be allowed to transfer illegal, or possibly damaging files or software on the creativeVPS network. Such activity would result in the immediate termination of your account.

4. CONFIDENTIALITY. creativeVPS will not intentionally look into any of a customer's files, emails, cache, etc. without expressed consent from the customer. A typical case of data viewing is when replying to a support ticket. creativeVPS takes no responsibility for the state of your files before or after submission of a support ticket. creativeVPS will not disclose any of your account information to a third party under any circumstance.

The customer acknowledges that no system on the Internet can be guaranteed safe from unauthorized intrusion, and therefore any confidential information stored on or transmitted through creativeVPS's system is stored or transmitted at the customer's own risk.

5. SECURITY CONCERNS. Customer is responsible for the safekeeping of the password used to gain administrative access to the customers server.

The customer will not be allowed to circumvent or "workaround" any of the security and/or safety measures set in place by creativeVPS. Such measures are in place to ensure the continuous service by creativeVPS to be received by the customer. Should the customer attempt to hack, steal, cheat, or circumvent any of the security measures and account systems placed by creativeVPS, their account will be subject to immediate termination, and the proper authorities will be contacted.

6. COPYRIGHT ISSUES. The customer agrees not to upload to, download from, make available for public access on, or transmit through creativeVPS's system any copyrighted material in violation of the copyright owner's rights in that material. By uploading, downloading, making available for public access, or transmitting any copyright-protected material, the customer warrants that the customer has the proper authorization to make or authorize the making of any copies involved with such uploading, downloading, making available for public access, or transmission. Unauthorized copying, or authorizing the copying of protected works in excess of any legal right through creativeVPS's system is a violation of federal law and international treaties, and may result in not only termination of Customer's account, but also may result in civil and/or criminal fines and prison sentences.

The customer agrees not to remove any copyright ownership information, or falsify such information, on any files uploaded, downloaded, made publicly available through, or transmitted via creativeVPS's system.

The customer explicitly licenses creativeVPS to make any copies of copyright protected materials necessary to provide Internet and related services to the customer, as well as make any necessary copies necessary to preserve and maintain creativeVPS's system and the customer's files and electronic mail.

The customer explicitly licenses creativeVPS to make any copies, without limitation, of any copyrighted materials submitted to a public forum maintained on creativeVPS's system, or submitted to any forum to which creativeVPS provides access. This clause cannot be modified by either party unless any modification is in writing and signed by both parties.

7. UNATTENDED FORMS. The customer is not allowed to run data-mining programs, data-polling utilities, or any program that requires the continuous stream of data over the creativeVPS network, unattended. Such activities can rack up bandwidth, as well as potentially send misleading or damaging information over the internet. The customer takes all responsibility for programs running on their service, and will run them in a responsible manner.

8. LEGAL PROCEEDINGS. creativeVPS is not responsible for any data loss, whether it be in transmission, or through storage. Customer agrees to hold creativeVPS harmless, and in court, indemnify creativeVPS, for data loss. The customer agrees not to press charges against creativeVPS for possible data loss. creativeVPS does not gaurantee any financial gain or loss by using it's services. The customer agrees not to press charges against creativeVPS for financial loss.

9. SERVICE LEVEL AGREEMENT. The customer agrees to all terms and policies set forth by the creativeVPS Service Level Agreement which can be viewed Here.

The following activities are strictly forbidden on all creativeVPS products

Use of a creativeVPS server as an IRC server. This includes bouncers, bots, and daemons. Running root exploit kits against other servers. Scanning other networks. Forging or misrepresenting message headers, in whole or in part. Intentional distribution of viruses, worms, trojan horses, or other destructive activities.
